By accessing and using the AmayzArt website (amayzart.com), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website.

AmayzArt reserves the right to modify these terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the site after changes constitutes acceptance of the modified terms.

• "We," "us," "our" refers to AmayzArt Family Collective
• "You," "your" refers to the user or purchaser
• "Site" refers to amayzart.com and all associated pages
• "Original Artwork" refers to one-of-a-kind paintings and mixed media pieces
• "Limited Editions" refers to numbered, signed reproductions with certificates of authenticity
• "Prints" refers to canvas prints and reproductions available through our print-on-demand services
• "Services" refers to commissions, consultations, and art placement services

You may use this site to:

• Browse and view artwork
• Inquire about purchasing original artwork, limited editions, or prints
• Request commission or consultation services
• Sign up for our email newsletter

You may NOT:

• Reproduce, download, or distribute images of our artwork without written permission
• Use our content for commercial purposes without authorization
• Attempt to access restricted areas of the site
• Harass, intimidate, or impersonate others
• Submit false or misleading information
• Use automated systems (bots, scrapers) to access the site

All content on this site, including but not limited to artwork images, photographs, text, graphics, logos, and design elements, is the property of AmayzArt Family Collective and is protected by U.S. and international copyright laws.

Individual artworks are created by and remain the intellectual property of the respective artists: Brooke Lumbus, Penny May Hineline, Alex May, and Pam Brown.

We grant you a limited, non-exclusive, non-transferable license to view and use the site for personal, non-commercial purposes only. This license does not include the right to:

• Download, reproduce, or redistribute artwork images
• Create derivative works
• Use images for commercial purposes
• Remove copyright notices or artist credits

When you purchase original artwork or limited edition prints, you acquire ownership of the physical piece but NOT the copyright or reproduction rights. The artist retains all intellectual property rights.

• Prices for original artwork and limited editions are available upon request
• Print prices are displayed on our print-on-demand site (amayzartcollective.com)
• All prices are in U.S. Dollars (USD)
• Prices are subject to change without notice
• Quoted prices are valid for 30 days unless otherwise specified

We accept:

• Credit and debit cards
• Payment plans (for purchases over $2500, terms to be agreed upon)
• Bank transfers (for large commissions)
• Other methods as mutually agreed

• Print purchases: Payment in full at time of order
• Original artwork: 50% deposit required, balance due before shipping
• Commissions: 50% deposit to begin work, 50% upon completion and approval
• Consultation services: Payment due at time of booking or within 7 days of invoice

Sales tax will be collected as required by applicable state and local laws.

• Inquiries for original artwork should be made via contact form or email
• Print orders are processed through our Shopify store
• Orders are subject to acceptance by AmayzArt
• We reserve the right to refuse or cancel any order

You will receive email confirmation of your order, including:

• Item description and price
• Payment terms
• Estimated delivery timeframe
• Shipping information

Original artworks are one-of-a-kind and available on a first-come, first-served basis. Limited editions are subject to edition limits. We are not responsible if an item becomes unavailable after inquiry but before purchase.

• Original artwork: Professional packaging and shipping via insured carrier
• Local delivery: Available for local clients (additional fees may apply)
• Installation services: Available by arrangement
• Prints: Shipped via print-on-demand fulfillment partner

• Shipping costs vary based on size, weight, destination, and insurance value
• Costs will be quoted and agreed upon before shipping
• International shipping available (customs duties are buyer's responsibility)

• Original artwork: 1-3 weeks from payment (depending on location)
• Commissions: 4-12 weeks from deposit (timeline provided at time of agreement)
• Prints: 7-14 business days from order

Risk of loss and title for purchased items pass to you upon delivery to the shipping carrier.

Inspect packages immediately upon receipt. Report damage to us within 48 hours with photographs. We will work with shipping carriers to resolve claims.

• 1-Month (30-Day) Window: If you're not entirely happy with your purchase but would prefer a different piece, we offer an exchange option within one month (30 calendar days) of the original purchase date. You can exchange your artwork for another piece of equal or greater value. If the new piece is of greater value, you will be responsible for paying the difference.
• 1-Week (7-Day) Window: You may return your artwork for an 80% refund within one week (7 calendar days) of the original purchase date. This allows you ample time to live with the piece and decide if it's the right fit for your collection. Please note that a 20% restocking fee will be applied to all refunds within this period. This fee helps cover the administrative costs associated with processing returns and preparing the artwork for resale,
• Fine Print: Important Considerations for Returns and Exchanges:
• Original Condition: All artwork must be returned or exchanged in its original, pristine condition. This includes all packaging, certificates of authenticity, and any accompanying materials. Artwork that shows signs of damage, wear, or alteration may not be eligible for a refund or exchange.
• Proof of Purchase: A valid proof of purchase (e.g., receipt, order confirmation) is required for all returns and exchanges.
• Shipping Costs: For returns or exchanges initiated by the customer, the customer is responsible for all shipping costs associated with returning the artwork to Amayz Art. We recommend using a trackable and insured shipping method to ensure the safe arrival of your return.
• Process: To initiate a return or exchange, please contact our customer service team at [Insert Contact Email/Phone Number Here] within the specified timeframes. We will provide you with detailed instructions on how to proceed.
• Custom Orders and Commissioned Art: Please note that custom orders and commissioned artwork are unique creations and are generally not eligible for returns or exchanges unless there is a significant defect or error on our part. We work closely with clients throughout the commissioning process to ensure satisfaction. 

• Print returns subject to print-on-demand partner's return policy
• Typically 30 days from receipt
• Items must be unused and in original packaging

• Custom commissions are non-refundable once work has begun
• Deposits are non-refundable
• If final piece does not match agreed specifications, we will work with you to resolve.

Consultation fees and digital mockup services are non-refundable once services are delivered.

All commissions require a written agreement specifying:

• Detailed description of requested work

• Minor adjustments included during creation process
• Significant changes may incur additional fees
• Once work is completed, no changes can be made

We reserve the right to refuse any commission request that:

• Is not feasible within requested timeline
• Requests subject matter we're uncomfortable creating
• Involves reproduction of copyrighted material
• Is beyond our artistic capabilities or style

We offer:

• In-home art consultation and placement services (local clients)
• Virtual consultations (remote clients)
• Digital mockups showing artwork in your space
• Curation and selection guidance

• In-home consultation: $[amount] (credited toward purchases over $[amount])
• Virtual consultation: $[amount] (credited toward purchases over $[amount])
• Digital mockup service: $[amount] per room

• Cancel in-home visits at least 48 hours in advance for full refund
• Same-day cancellations forfeit 50% of consultation fee

All original artworks and limited editions include a Certificate of Authenticity containing:

• Artist name and signature
• Title of work
• Year created
• Medium and dimensions
• Edition number (for limited editions)
• Unique identification number

Certificates should be retained for provenance and insurance purposes.

We collect:

• Contact information (name, email, phone, address)
• Payment information (processed securely, not stored)
• Communication history
• Website usage data (cookies)

Your information is used to:

• Process orders and inquiries
• Provide requested services
• Send marketing communications (with consent)
• Improve website functionality
• Comply with legal obligations

By signing up for our email list, you consent to receive:

• New collection announcements
• Exclusive previews and offers

To the fullest extent permitted by law, AmayzArt shall not be liable for:

• Indirect, incidental, consequential, or punitive damages

• Damages exceeding the amount paid for the item or service in question

While we take care to accurately photograph and describe artwork:

• Colors may vary due to screen settings
• Sizes are approximate
• We encourage consultations and mockups before purchase

You agree to indemnify and hold harmless AmayzArt, its artists, and affiliates from any claims, damages, or expenses arising from:

• Your use of the site
• Your violation of these terms
• Your violation of any third-party rights

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

You agree to resolve disputes individually, not as part of a class action.
